General Terms and Conditions

No purchase, payment, or donation of any kind is necessary to enter or win. All entries (each referred to as a “Draw NFT” or “NFT”) into a Prize Draw have an equal chance of winning.

By participating in any of our Prize Draws, you (“Participant”, “User”, “you”, or “your”) agree to abide by the following terms and conditions ("General Terms"):

1) THE WEBSITE: Fortune Master (“FortuneMaster.io”, “we”, "us", “our”, "the Promoter" or “the Project”) operates the www.FortuneMaster.io website (the “Website”), a platform that allows individuals to enter prize draws hosted on the Website (each a “Prize Draw”). A portion of the funds raised through each Prize Draw will be used to support the project’s operations, licensing, growth, and/or non-profit or charitable causes (each a “Charity”).

2) APPLICABILITY OF THESE TERMS AND CONDITIONS: These General Terms apply to all activities, features, and promotions provided on the Fortune Master platform, including (but not limited to) prize draws, NFT rewards, bonuses, and contests launched on or after 2024. Each Prize Draw or promotion is void where prohibited.

3) ELIGIBILITY: To be eligible to enter a Prize Draw or be awarded the prize(s) identified on the Website (each a “Prize”), a Participant must fully comply with the Terms and Conditions. Prize Draws are intended for individuals who meet the following criteria: (i) are legal adults in their respective countries and jurisdictions at the time of entry; (ii) are legal residents of countries where local laws permit entry into online Prize Draws. It is the responsibility of the participant to ensure that their participation in online Prize Draws is legal according to the laws of their country or jurisdiction. Participation in these Prize Draws is void where prohibited by law.

4) ONLINE PARTICIPATION: Participants must have access to the internet and be able to participate in online Prize Draws in accordance with the laws of their country or jurisdiction. It is the participant's responsibility to ensure that their participation in online Prize Draws is permitted by law.

5) USE OF CRYPTOCURRENCY: Our Prize Draws may involve the use of cryptocurrency for entry and/or prizes. Participants must have the legal ability to use cryptocurrency in their country or jurisdiction. It is the participant's responsibility to ensure that their use of cryptocurrency is compliant with applicable laws and regulations.

6) HOW TO ENTER: The Entry Period of each Prize Draw starts the moment the smart contract is deployed on each blockchain. The Entry Period will continue until all entries are sold out, at which point the draw will automatically take place. Only those entries received by the Promoter before the draw is completed will be valid. The Promoter will be the official timekeeper for all Prize Draws.

All Prize Draws (each a “Prize Draw”) will provide the following two (2) methods of entry:

  1. Paid Method of Entry: To enter by this method, visit www.FortuneMaster.io and select the Prize Draw you want to participate in. Choose the applicable entry amount to purchase (there is a limit of 100 entries per transaction), click on the “Buy Now” button and complete your payment. Once your payment is complete, you will receive the number of entries you selected and be entered for a chance to win the Prize Draw once the transaction is approved by the blockchain. You can enter as many times as you wish so long as you don’t exceed the maximum Entry Limit (as defined below), if applicable.

  2. Alternate Method of Entry: Write the date, your full legal name, home address (no post office box addresses accepted), city, post code, email address, the Prize Draw name and code you want to enter (for example, Violet Draw 01-001-0001), your EVM-compatible address, your acceptance of all our terms and conditions, and your signature on an A4 sheet of paper. Post the completed entry to the postal address provided in the Postal Entry Route. All entries must be received via post (hand delivered entries are not eligible and will be void) before the entries are sold out to be valid. Limit one (1) entry per outer mailing envelope. Each eligible entry received via the Alternate Method of Entry will be equivalent to a single entry into the Prize Draw, with effect from the date that an entry is received and processed. No mechanically reproduced entries are permitted. Illegible entries are void. FortuneMaster.io is not responsible for lost, late, mutilated, delayed, inaccurate, incomplete, postage due, misdirected entries or entries not received by the applicable Entry Period. You can enter by the Alternative Method of Entry as many times as you wish so long as you don’t exceed the applicable maximum Entry Limit.

7) VERIFICATION OF ELIGIBILITY: The Promoter reserves the right to verify the eligibility of participants and may require proof of age, residency, or any other relevant information to determine eligibility. Failure to provide requested verification may result in disqualification from the prize draw.

8) ENTRY LIMITATIONS AND RESTRICTIONS: Only accurate and complete entries submitted during the Entry Period and received by Promoter are eligible. Any incomplete, illegible, corrupted, or untimely entries are void and ineligible to win. Proof of submission will not be deemed to be proof of receipt by Promoter. Promoter is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled entries, or for other submission problems of any kind, whether caused by mechanical, human or electronic error, all of which are void and ineligible to win. Additionally, Promoter is not responsible for any telephone, electronic, hardware, software, network, Internet, or computer malfunctions, failures, or difficulties. If a Participant’s entry fee is refunded, any entries associated with such entry fee will be withdrawn and not eligible to win.

  1. Entry Limit: Unless otherwise stated in the Prize Draw, there is no cumulative maximum number of entries that any one person may obtain (the “Entry Limit”). However, in respect of the Paid Method of Entry only, the Promoter reserves the right at any time to (i) introduce an Entry Limit; and/or (ii) limit the amount that any Participant may spend (whether in aggregate, on a particular Prize Draw, or via a particular payment method) in a defined period or otherwise. Unless otherwise stated in the Prize Draw, there shall be no such Entry Limit in respect of the Alternate Method of Entry. If a Participant exceeds an applicable Entry Limit for a Prize Draw, all entries in excess of the Entry Limit will be void and ineligible to win. FortuneMaster.io will not refund Participants for any Entry Fees that the Participant paid for those void and ineligible entries that exceed the applicable Entry Limit.

  2. No Automated Entry Devices: All entries must be submitted by the individual Participant to be valid. The use, or attempted use, of any robotic, automated, programmed, mechanical, or other non-manual entry methods will void all entries for that Participant and result in the disqualification of the Participant from all Prize Draws, at the Promoter’s discretion. No copies, facsimiles, or other mechanical or electronic reproductions of entries will be accepted. The Promoter has the sole right and discretion to determine whether a Participant used or attempted to use any such prohibited automated entry methods.

9) ENTRY CONDITIONS AND RELEASE: As a condition of entering any Prize Draws, Participant expressly:

  1. Represents and warrants that (s)he agrees to be bound by the Terms and Conditions and decisions of the Promoter, which will be binding and final in all matters relating to each Prize Draw; and

  2. Releases the Prize Draw Partners, and any advertising platform used in connection with the promotion of any Prize Draw, from all liability, loss or damage or expense arising out of or in connection with participation in any Prize Draw or the acceptance, use, or misuse of any Prizes.

10) WINNER DRAWINGS: Potential winner(s) of a Prize Draw (each a “Potential Winner”) will be selected using a verifiably random process from among all eligible entries received. The drawing will occur automatically immediately after the last entry is sold or received. The three (3) selected winning unique entry numbers with the corresponding EVM-compatible address(es) of the winner(s) will be announced on the Website in accordance with these Terms and Conditions. The odds of winning depend on the number of eligible entries received during the Entry Period.

11) TRANSFERABILITY OF ENTRIES: Participants acknowledge and agree that the entries issued for participation in the Prize Draws are non-transferable and unsalable. Participants may not sell, transfer, or otherwise dispose of their entries to any other person or entity. Any attempt to transfer, sell, or otherwise dispose of entries will be considered null and void. The smart contract governing the Prize Draws will enforce this restriction, and participants are advised that attempting to transfer entries in violation of this rule will result in a failed transaction on the blockchain. Participants acknowledge that any failed transactions will result in the loss of the transaction fee associated with the attempted transfer, and the Promoter bears no responsibility for such losses. Participants may only use their entries for the purpose of participating in the Prize Draws as outlined in these Terms and Conditions. Violation of this provision may result in disqualification from current and future Prize.

12) DISQUALIFICATION: A Participant and/or Potential Winner may be ineligible to receive the Prize(s) and/or disqualified for the following reasons: (i) failure to meet all of the eligibility requirements stated in the Terms and Conditions, (ii) failure to abide by these Terms and Conditions, (iii) failure to provide a valid email address at the time of entry, (iv) the provision of false, incomplete, and/or misleading information to the Promoter or any of the other Prize Draw Partners, (v) the commission of any fraud or deception in connection with any Prize Draws, use of the Website, and/or relationship with the Promoter, (vi) acting in a threatening, abusive, or harassing manner at any time towards the Promoter and/or any of its personnel, (vii) the inability of the Promoter to timely award or otherwise fulfill the Prize(s) due to circumstances beyond the Promoter’s reasonable control, including but not limited to legal restrictions, acts of God, natural disasters, pandemics/epidemics, network failure, terrorism, and/or weather.

13) PRIZES: Subject to any restrictions expressly stated in the Terms and Conditions, Winners will receive the cryptocurrency Prize(s) identified on each Prize Draw’s webpage.

  1. Unless explicitly stated otherwise, all cryptocurrency Prizes are awarded as is, without any representations or warranties (other than those which cannot be excluded by applicable law), and cannot be transferred, sold, substituted, or redeemed for cash by the Participant. FortuneMaster.io reserves the right, in FortuneMaster.io’s sole discretion, to substitute any cryptocurrency Prize with an alternative cryptocurrency asset of comparable or greater value.

  2. Unless expressly stated otherwise, Winners are solely responsible for any and all applicable taxes, fees, and expenses related to acceptance, ownership, and use of a cryptocurrency Prize. Promoter will not replace any lost or stolen cryptocurrency Prize(s) or components of a Prize. Cryptocurrency Prize(s) cannot be used in conjunction with any other Prize Draw or offer. Only the number of cryptocurrency Prizes stated in the Prize Draw webpage are available to be won in a Prize Draw.

14) CRYPTOCURRENCY VOLATILITY DISCLAIMER: Participants acknowledge and understand that cryptocurrency prizes are subject to market volatility, and their value may fluctuate significantly over time. While efforts are made to match the USD value of the prizes at the time of launching the smart contract, the actual value of the cryptocurrency prizes may vary at the time of distribution to the winners. The Promoter cannot guarantee or be held responsible for the specific value of the cryptocurrency prizes at the time of distribution. Participants accept and assume all risks associated with cryptocurrency prizes and agree that the Promoter shall not be liable for any loss or gain in the value of the prizes.

15) SMART CONTRACT DISCLAIMER: Our smart contracts are being provided as is. No guarantee, representation or warranty is being made, express or implied, as to the safety or correctness of the user interface or the smart contracts. They have not been audited yet and as such there can be no assurance they will work as intended, and users may experience delays, failures, errors, omissions or loss of transmitted information. The Promoter is not liable for any of the foregoing. Users should proceed with caution and use at their own risk.

16) PUBLICITY: Except where prohibited by law, acceptance of any Prize also constitutes the Winner’s express agreement and consent for the Promoter, and those acting under the Promoter’s authority, to use, publish, or make available information that indicates a valid award took place for each of the Prize Draws. This may include the entry number, the EVM-compatible address of the Winner, and the Winner's social media profile or handle. Such information may be used worldwide and in perpetuity for any and all purposes, including advertising, trade, and promotion on behalf of the Promoter, in any and all forms of media, now known or hereafter devised, including print, TV, radio, electronic, cable, social media, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. The Winner agrees to confirm this consent in writing if requested.

Some jurisdictions may prohibit the Promoter from conditioning the awarding of a Prize on the Winner’s consent to publicity as described in this Section 15. Winners who are residents of such jurisdictions and who object to such publicity must notify the Promoter of such objections via email within 72 hours of the winner drawing. In such circumstances, entrants acknowledge that FortuneMaster.io must nevertheless still provide the information and winning entry to the ASA or equivalent regulator upon request.

17) GENERAL CONDITIONS: FortuneMaster.io reserves the right to cancel, suspend, and/or modify any Prize Draw, in whole or in part, due to any fraud, bugs, virus, technical failures, changes in the law, insufficient entries during the Entry Period, or any other factor beyond FortuneMaster.io’s reasonable control that impairs the integrity or proper functioning of a Prize Draw, as determined in FortuneMaster.io’s sole discretion. The Promoter also reserves the right, in its sole discretion and at any time, to conduct maintenance on the Website or its systems, which may temporarily suspend or otherwise impact access to a Prize Draw. The Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process, the operation of a Prize Draw, or the drawing of potential winners.

WARNING: ANY ATTEMPT BY YOU OR ANY OTHER INDIVIDUAL DELIBERATELY TO DAMAGE ANY WEBSITE ASSOCIATED WITH A PRIZE DRAW OR UNDERMINE, OR ATTEMPT TO UNDERMINE, THE LEGITIMATE OPERATION OF A PRIZE DRAW MAY BE A BREACH OF CRIMINAL AND CIVIL LAW, AND SHOULD SUCH AN ATTEMPT BE MADE, FORTUNEMASTER.IO RESERVES THE RIGHT TO CLAIM AGAINST AND SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. FORTUNEMASTER.IO RESERVES THE RIGHT TO DISQUALIFY, AT ITS SOLE DISCRETION, ANY INDIVIDUAL IT DETERMINES TO BE: (A) TAMPERING OR ATTEMPTING TO TAMPER WITH OR UNDERMINE THE ENTRY PROCESS, THE WEBSITE, AND/OR THE LEGITIMATE OPERATION OF THE PRIZE DRAW; (B) VIOLATING THESE TERMS AND CONDITIONS; OR (C) ACTING IN AN UNSPORTSMANLIKE, DISRUPTIVE, ABUSIVE, THREATENING, OR HARASSING MANNER. IF, FOR ANY REASON, A PRIZE DRAW CANNOT BE RUN AS PLANNED OR IF FORTUNEMASTER.IO DETERMINES IN ITS SOLE DISCRETION THAT THE INTEGRITY OR VIABILITY OF A PRIZE DRAW IS COMPROMISED, FORTUNEMASTER.IO MAY, IN ITS SOLE DISCRETION, VOID ANY SUSPECT ENTRIES AND (A) CANCEL OR TERMINATE THE PRIZE DRAW (OR ANY PORTION THEREOF); (B) MODIFY THE PRIZE DRAW OR SUSPEND THE PRIZE DRAW TO ADDRESS THE ISSUE AND THEN RESUME IT IN A MANNER CONSISTENT WITH THE SPIRIT OF THESE TERMS AND CONDITIONS; AND/OR (C) AWARD THE PRIZE AT RANDOM FROM AMONG THE ELIGIBLE, NON-SUSPECT ENTRIES RECEIVED UP TO THE TIME OF THE IMPAIRMENT.

18) CONTEST TERMS AND CONDITIONS: Participants who join any of the Project’s contests are subject to the Contest Terms and Conditions. For the full Contest Terms and Conditions, please review CONTEST TERMS AND CONDITIONS.

20) “THE JOURNEY” TERMS AND CONDITIONS: Participants who claim or use NFTs from “The Journey” NFT collection, are subject to the Terms and Conditions of “The Journey” NFT Reward Collection, which govern eligibility, distribution mechanics, and associated perks. 21) THE FORTUNE CLUB & FORTUNE GEMS TERMS AND CONDITIONS: Participants who join The Fortune Club Loyalty Program or claim or use Fortune Gems, are subject to The Fortune Club Loyalty Program & Fortune Gems Terms and Conditions. 22) FORTUNE AMBASSADORS PROGRAM TERMS AND CONDITIONS: Participants who join the Fortune Ambassadors Program, are subject to the Fortune Ambassadors Program Terms and Conditions. 23) REFUNDS, RETURNS, AND EXCHANGES: All Entry Fees are final and non-refundable. A portion of each Entry Fee may support charitable or operational purposes, and each Draw NFT grants eligibility to participate in a Prize Draw with no guarantee of winning. FortuneMaster.io does not offer refunds, returns, or exchanges for Entry Fees, Draw NFTs, or any costs associated with acquiring them (including, but not limited to, blockchain transaction fees, gas fees, or shipping/delivery expenses).

24) CHANGES TO THESE TERMS AND CONDITIONS: FortuneMaster.io may amend or modify these Terms and Conditions at any time without prior notice by posting the amended Terms and Conditions on the Website, and you agree that you will be bound by any changes to these Terms and Conditions from the date they are published on the Website. If, however, you have already entered a Prize Draw, the changes will not apply to any entries that you have already submitted, but they will apply to any future entries that you submit after the date on which the change become effective. It is the responsibility of participants to review these Terms and Conditions regularly to stay informed of any changes. Continued participation constitutes acceptance of the updated Terms.

25) PARTICIPANT’S BREACH OF THESE TERMS AND CONDITIONS: Participant is responsible for compensating the Promoter in full for any losses or damage they suffer which is caused by Participant’s breach of these Terms and Conditions.

2) LIMITATION OF LIABILITY; SOLE AND EXCLUSIVE REMEDY: FortuneMaster.io and its affiliates, partners, employees, and agents are not responsible and will have no obligation or liability for or resulting from: (i) a Participant’s entry or attempt to participate in a Prize Draw, (ii) incorrect or incomplete information, whether caused by a Participant, technical errors or by any of the equipment or programming associated with or used in a Prize Draw, (iii) technical failures of any kind, including, but not limited to outages, malfunctions, interruptions, or disconnections in phone lines or network hardware or software or scheduled or unscheduled maintenance; (iv) unauthorized human intervention in any part of the entry process or a Prize Draw; (v) technical or human error in the administration of a Prize Draw or the processing of entries or notifications; (vi) entries, Prize claims, or Prize notifications that are lost, late, incomplete, illegible, unintelligible, damaged, undeliverable, or otherwise not received by the intended recipient, in whole or in part, due to computer, human, or technical error of any kind (including, for example, SPAM filters); (vii) fraud, deception, or misconduct by Participants; (viii) a Winner’s inability to accept a Prize; (ix) failure or delay in delivering any Prize due to force majeure events, including but not limited to Acts of God, natural disasters, pandemics/epidemics, network failure, terrorism, weather, war, cyberattacks, governmental restrictions or any other similar event beyond the Promoter’s reasonable control; (x) any damages, injuries, or losses of any kind caused by any Prize or resulting from awarding, acceptance, possession, use, misuse, loss, or misdirection of any Prize or resulting from participating in a Prize Draw or any promotion or Prize related activities. If for any reason, a Participant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the Participant’s sole remedy is a replacement entry (if feasible).

Nothing in these Terms and Conditions excludes or limits Promoter’s liability for: (i) death or personal injury caused by Promoter's negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any matter in respect of which it would be unlawful for Promoter to exclude or restrict its liability.

To the maximum extent permitted by law, Participants expressly waive all rights to claim punitive, consequential, exemplary, incidental, or any other damages. In no event shall the Promoter’s total aggregate liability, whether in contract, tort, or otherwise, exceed one hundred U.S. dollars (USD $100).

27) GENERAL:

  1. Amendments and Revisions: FortuneMaster.io reserves the right to amend or update these Terms and Conditions at any time by publishing the revised version on the Website. Continued participation in the Prize Draws after any changes are posted constitutes your acceptance of the updated Terms.

  2. Relationship of Parties: You agree that nothing in these Terms and Conditions and your use of the Website, Software, or Service do not create any joint venture, partnership, employment, agency, or fiduciary relationship between you and FortuneMaster.io. You agree that you are participating as an independent user.

  3. Assignment: FortuneMaster.io may assign, transfer, or delegate its rights and obligations under these Terms and Conditions, in whole or in part, to any person or entity at any time without notice or consent. You may not assign or transfer your rights or obligations under these Terms and Conditions without FortuneMaster.io’s prior written consent, and any attempt to do so will be void.

  4. Severability: Each of the terms of these Terms and Conditions operates separately. If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be severed from the rest of the agreement and will not affect the validity and enforceability of any remaining provisions.

  5. No Waiver: If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

  6. Notices: All notices given by you or required under these Terms and Conditions shall be in writing and addressed to: FortuneMaster, Cesar Endara E8-55, Quito,Ecuador, 170809, Attn: FortuneMaster Customer Service.

  7. Entire Agreement: These Terms and Conditions, together with any additional rules or policies published by FortuneMaster.io (including the Contest Terms, “The Journey” Terms, and the Bonus Terms), constitute the entire agreement between you and FortuneMaster.io with respect to the Prize Draws and the broader project ecosystem. They supersede all prior or contemporaneous communications and agreements, whether electronic, oral or written.

28) PERSONAL INFORMATION HANDLING: The Promoter may collect and use limited personal information, such as social media profiles or handles and EVM-compatible address, for the purposes of publicly announcing Prize winners and promoting the Prize Draws. By participating in the Prize Draws, Participants consent to the collection and use of such information for these purposes. The Promoter will not disclose or sell personal information to third parties without consent, except as required by law. Participants can request to review, update, or delete their personal information by contacting the Promoter.

FortuneMaster.io is the promoter of all Prize Draws. All questions and concerns regarding these Terms and Conditions should be directed to support@fortunemaster.io.
